Continuation of Documentation for TPS Beneficiaries for Six Countries; Documents Auto-Extended Through June 30, 2024
The Department of Homeland Security (DHS) today published a Federal Register notice extending the validity of Temporary Protected Status (TPS)-related documentation for beneficiaries under the TPS designations for El Salvador, Honduras, Nepal, Nicaragua, and under the 2011 designation of Haiti and the 2013 designation of Sudan provided they remain individually eligible for TPS.
The notice automatically extends through June 30, 2024, the validity of Forms I-766, Employment Authorization Documents (EADs); Forms I-797, Notice of Action; and Forms I-94, Arrival/Departure Record (collectively, TPS-related documentation) for beneficiaries under the TPS designations for these six countries. The notice also provides instructions for beneficiaries who wish to request a new EAD with a June 30, 2024, expiration date.
DHS is extending the TPS-related documents in compliance with the preliminary injunction order of the U.S. District Court for the Northern District of California in Ramos et al. v. Nielsen et al. and with the order of the U.S. District Court for the Northern District of California to stay proceedings in Bhattarai v. Nielsen. While the court orders remain in effect, TPS beneficiaries under the designations for El Salvador, Honduras, Nepal, Nicaragua, and under the 2011 designation of Haiti and the 2013 designation of Sudan retain TPS so long as they otherwise continue to meet the eligibility requirements for TPS.
Please see the USCIS country-specific TPS webpages for more information about the impact of these orders.
Individuals with a pending or approved TPS application may qualify for certain public benefits and REAL ID driver's licenses and identification cards. When applying for a Federal, state, or local government benefit, individuals will need to show a document proving they applied for or are beneficiaries of TPS. They may provide a TPS-based EAD with a category code of A12 or C19, or a copy of their Form I-797, Notice of Action, for a current Form I-821, Application for Temporary Protected Status.
SAVE will be able to verify an individual's TPS or pending TPS application (and any employment authorization, including any EAD auto-extension) using information from the documents noted above. In some instances, the benefit-granting agency may need to institute additional verification.
For more information regarding the automatic extension of TPS-related documents for beneficiaries from the aforementioned six countries, including which documents have been automatically extended, please refer to the Federal Register Notice dated Nov. 16, 2022.
