Until further notice, employers should continue using the Form I-9, Employment Eligibility Verification, currently available on the USCIS forms page at I-9, Employment Eligibility Verification. This current version of the form continues to be effective even after the OMB control number expiration date of August 31, 2012 has passed. USCIS will provide updated information about the new version of the Form I-9 as it becomes available.
On August 9, 2012, USCIS entered into a negotiated settlement in Dayo, et al. v. Napolitano, 11-cv-00728, in the United States District Court for the Central District of California. Plaintiffs are aliens who are in removal proceedings in the Immigration Court in Los Angeles, California, who renewed their adjustment of status application in removal proceedings and who were denied employment authorization by USCIS.
