Regional Center Program Authorization
At the end of the day on Dec. 21, 2018, the EB-5 Immigrant Investor Regional Center Program expired due to a lapse in congressional authorization to continue the program. However, on Jan. 25, 2019, President Trump signed legislation that reauthorized the EB-5 Regional Center Program through Feb. 15, 2019. On Feb. 15, the president signed legislation further extending the EB-5 Regional Center Program through Sept. 30, 2019.
If you have not yet filed your Form I-924A, Annual Certification of Regional Center, for fiscal year 2018, we will accept the form as timely filed until March 17, 2019.
If you have not yet filed an amendment as required under paragraph 2A(1) or complied with the notification requirements under paragraph 2B on page one of the Form I-924 Instructions (PDF) due to the recent lapse:
- You must file any amendment required under paragraph 2A(1) on page one of the Form I-924 Instructions immediately following the posting of this notice.
- You must file any notification required under paragraph 2B on page one of the Form I-924 Instructions by March 17, 2019
The Regional Center Program’s lapse did not affect the adjudication of Form I-829, Petition by Entrepreneur to Remove Conditions on Permanent Resident Status.
If you wished to file Form I-290B, Notice of Appeal or Motion, on a decision relating to the adjudication of a Form I-924 or regional center-affiliated Form I-526, but did not do so because the deadline fell during the lapse, you may follow the instructions regarding special circumstance requests on the USCIS website and request to submit your motion or appeal. Please submit any such special circumstance requests by March 17, 2019.
If you received a Request for Evidence (RFE), Notice of Intent to Deny (NOID), Notice of Intent to Revoke (NOIR), or Notice of Intent to Terminate (NOIT) before the lapse, we will contact you individually in writing.
