H-2A Petitions: Best Filing Practices

On June 10, 2011, USCIS invited interested parties to participate in a teleconference to discuss best practices for filing H-2A petitions.
Recently, some H-2A petitioners have experienced unexpected delays due to Requests for Evidence (RFEs) resulting from the use of the Validation Instrument for Business Enterprises (VIBE). As delays in adjudication are especially burdensome for H-2A petitioners, USCIS recently posted an H-2A Optional Checklist as well as a Questions & Answers document to help petitioners ensure that their petitions are expeditiously processed. This engagement was an opportunity for USCIS to share best filing practices with H-2A employers, associations and agents and to address any questions or concerns.
